The federal appeals court has maintained a ban on sending state troops in Portland, Oregon, after a recent legal decision.

Appeals Court Concurs to Reconsider Legal Matter

The ninth circuit court of appeals ruled on Tuesday that it would reexamine the case concerning the executive power with an expanded panel of eleven justices. The judicial body also overturned a previous decision from a three-judge panel that had supported the federal government.

Ongoing Dispute Over Military Presence

This legal directive represents the latest development in a long-running court case over whether the administration has the authority and justification to send state military units in the city. Approximately 200 federalized guard members have been in limbo since the end of September when the deployment effort was started in response to months of protests.

Differing Viewpoints

The federal government has argued that government employees at the ICE facility in the southern part of the city were under attack, while city and state officials maintain that local officers have control of the situation.

In defiance of characterizations of the city as a conflict zone, residents have been sharing footage of scenic paths and a vibrant culinary culture, and planning events such as an Emergency Naked Bike Ride against the “militarization of our city”.

Court Proceedings

The appeals court decision came after a federal judge in Portland issued two legal injunctions this period – one blocking the federalization of the state troops, and another prohibiting the deployment of any military personnel in the state, after attempts to circumvent the first order by mobilizing troops from California.

On Monday, the appeals court had put the first ruling on hold – permitting control of state troops – but the subsequent injunction remained in place, preventing the physical sending of the forces.

En Banc Review

The Tuesday decision means the matter will be heard by the full court – with all decisions under consideration simultaneously – by a group of 11 judges.

“This decision shows that the truth matters and that the judicial system are striving to hold this administration accountable. The founding document limits the president’s power, and local populations cannot be treated as a testing site for expansive government power,” said the state attorney general in a official comment.

“The court is sending a clear message: the president cannot send the military into US cities unnecessarily. We will continue protecting state legislation, values, and autonomy as this legal proceeding progresses and our fight continues in the courts.”
